District-Wide School Safety Plan
Emergencies and violent incidents in school districts are critical issues that must be addressed in an expeditious and effective manner. Districts are required to develop a District-wide School Safety Plan designed to prevent or minimize the effects of serious violent incidents and emergencies and to facilitate the coordination of the district with local and county resources in the event of such incidents or emergencies. The district-wide plan is responsive to the needs of all schools within the district and is consistent with the more detailed emergency response plans required at the school building level. Districts are at risk of a wide variety of acts of violence, natural, and technological disasters. To address these threats, the State of New York has enacted the Safe Schools Against Violence in Education (SAVE) law. This component of Project SAVE is a comprehensive planning effort that addresses risk reduction/prevention, response, and recovery with respect to a variety of emergencies in the school district and its schools. Sandy Creek Central School District continues to support this integral component of the SAVE Legislation through the regular review and updating of its contents. The Superintendent of Schools encourages and advocates this ongoing district-wide cooperation and support of Project SAVE.

Initial Notification Regarding Pesticide Use
New York State Education Law Section 409-H, effective July 1, 2001, requires all public and nonpublic elementary and secondary schools to provide written notification to all persons in parental relation, faculty, and staff regarding the potential use of pesticides periodically throughout the school year.
The Sandy Creek Central School District is required to maintain a list of persons in parental relation, faculty, and staff who wish to receive 48-hour prior written notification of certain pesticide applications. The following pesticide applications are not subject to prior notification requirements:
A school remains unoccupied for a continuous 72-hour following an application,
* Anti-microbial products;
* Nonvolatile rodenticides in tamper resistant bait stations in areas inaccessible to children;
* Nonvolatile insecticidal baits in tamper resistant bait stations in areas inaccessible to children;
* Silica gels and other nonvolatile ready-to-use pastes, foams, or gels in areas inaccessible to children;
* Boric acid and disodium octaborate tetrahydrate:
* The application of EPA designated biopesticides;
* The application of EPA designated exempt materials under 40CFR152.25;
* The use of aerosol products with a directed spray in containers of 18 fluid ounces or less when used to protect individuals from an imminent threat from stinging and biting insects including venomous spiders, bees, wasps, and hornets.
In the event of an emergency application necessary to protect against an imminent threat to human health, a good faith effort will be made to supply written notification to those on the 48-hour prior notification list.

Parents' Bill of Rights for Data Privacy and Security
The Sandy Creek Central School District is committed to protecting the privacy and security of student, teacher, and principal data. In accordance with New York Education Law § 2-d, the Sandy Creek Central School District is providing this Parents Bill of Rights for Data Privacy and Security.
1. A student’s personally identifiable information (PII) cannot be sold or released for any commercial purpose. PII, as defined by Education Law § 2-d and FERPA, includes direct identifiers such as a student’s name or identification number, parent’s name, or address; and indirect identifiers such as a student’s date of birth, which when linked to or combined with other information can be used to distinguish or trace a student’s identity. Please see FERPA’s regulations at 34 CFR 99.3 for a more complete definition.
2. The right to inspect and review the complete contents of the student’s education record stored or maintained by an educational agency. This right may not apply to parents of an Eligible Student. The procedures for exercising this right can be found in Board Policy 5500, Student Records.
3. State and federal laws such as Education Law § 2-d; the Commissioner of Education’s Regulations at 8 NYCRR Part 121, the Family Educational Rights and Privacy Act ("FERPA") at 12 U.S.C. 1232g (34 CFR Part 99); Children's Online Privacy Protection Act ("COPPA") at 15 U.S.C. 6501-6502 (16 CFR Part 312); Protection of Pupil Rights Amendment ("PPRA") at 20 U.S.C. 1232h (34 CFR Part 98); the Individuals with Disabilities Education Act (“IDEA”) at 20 U.S.C. 1400 et seq. (34 CFR Part 300); protect the confidentiality of a student’s identifiable information.
4. Safeguards associated with industry standards and best practices including but not limited to encryption, firewalls and password protection must be in place when student PII is stored or transferred.
5. A complete list of all student data elements collected by NYSED is available at http://www.nysed.gov/data-privacy-security/student-data-inventory and by writing to: Chief Privacy Officer, New York State Education Department, 89 Washington Avenue, Albany, NY 12234.
6. The right to have complaints about possible breaches and unauthorized disclosures of PII addressed. Complaints may be submitted to SCCS by mail to: Data Protection Officer, Sandy Creek Central School District, 124 Salisbury St, Sandy Creek, NY 13145; by email to privacy@sccs.cnyric.org; or by telephone at 315-387-3445.
7. To be notified in accordance with applicable laws and regulations if a breach or unauthorized release of PII occurs.
8. Educational agency workers that handle PII will receive training on applicable state and federal laws, policies, and safeguards associated with industry standards and best practices that protect PII.
9. Educational agency contracts with vendors that receive PII will address statutory and regulatory data privacy and security requirements.
Supplemental Information Regarding Third-Party Contractors
As a parent, you may be aware the New York State Education Department is making a stronger push to monitor the efficacy of school districts in meeting the mandates set forth by part 121 of Education Law 2-D. These actions are being taken by the state to ensure that student (and some teacher) data privacy is being regarded with the utmost security, both in-district and by any approved third parties.

The following rules of conduct, focusing on personal safety and respect for the rights and property of others, apply both in the classrooms and throughout the school. Students who fail to meet these standards will face disciplinary action appropriate to the seriousness of the offense. For students with disabilities, all regulations in Part 200.10 of the Education Law will be adhered to.

Supplemental Information Regarding Third-Party Contractors
In the course of complying with its obligations under the law and providing educational services, Sandy Creek Central School District has entered into agreements with certain third-party contractors. Pursuant to such agreements, third-party contractors may have access to "student data" and/or "teacher or principal data," as those terms are defined by law. Each contract the Sandy Creek Central School District enters into with a third party contractor where the third party contractor receives student data or teacher or principal data will include the following information:
(1) the exclusive purposes for which the student data or teacher or principal data will be used;
(2) how the third party contractor will ensure that the subcontractors, persons or entities that the third party contractor will share the student data or teacher or principal data with, if any, will abide by data protection and security requirements;
(3) when the agreement expires and what happens to the student data or teacher or principal data upon expiration of the agreement;
(4) if and how a parent, student, eligible student, teacher or principal may challenge the accuracy of the student data or teacher or principal data that is collected; and
(5) where the student data or teacher or principal data will be stored (described in such a manner as to protect data security), and the security protections taken to ensure such data will be protected, including whether such data will be encrypted.
